Welcome to 84pins (“84pins”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of:
- Our website at 84pins.com and any subdomains (the “Site”), and
- Our done-for-you Pinterest posting and related services (the “Services”).
By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

1. Eligibility
To use the Services, you must:
- Be at least 18 years old (or the age of majority in your jurisdiction), and
- Have the authority to enter into these Terms on behalf of yourself or the business you represent.
By using the Services, you represent and warrant that you meet these requirements.
2. Description of the Services
84pins provides done-for-you Pinterest posting services for brands, which may include:
- Creating or optimizing Pinterest business accounts and profiles
- Organizing and naming boards
- Designing and scheduling Pinterest posts (“Pins”) using your approved content
- Writing titles and descriptions informed by search intent
- Ongoing posting at the daily cadence associated with your selected plan (e.g., 1x/day, 3x/day, 6x/day)
Unless stated otherwise in writing, we are not an agency of record and do not provide:
- Full-funnel media buying across platforms
- Legal, financial, or tax advice
- Performance guarantees (see Section 12)
We are not affiliated with Pinterest. Pinterest is a separate company and platform with its own terms and policies.
3. Account Setup & Onboarding
After you purchase a plan or start a promotional offer, you will be directed to an onboarding form where you provide:
- Website URL(s)
- Pinterest account details or a request for us to help create/configure your account
- Content sources (e.g., website, Google Drive/Dropbox links)
- Brand assets (logos, colors, fonts) and guidance
- Any other relevant instructions or preferences
You agree to:
- Provide accurate, current, and complete information
- Update us promptly if any key information changes
- Respond in a reasonable time to basic questions that affect our ability to post on your behalf
We typically require a setup window of approximately 2–4 business days after onboarding before daily posting begins. This setup period is part of the Service and does not entitle you to a refund or extension unless otherwise agreed in writing.
4. Plans, Posting Cadence & “84 Pins” Guarantee
We offer different plans that specify a daily posting cadence (for example, 1x/day, 3x/day, or 6x/day). The details and pricing of these plans are described on the Site or in your checkout flow.
For plans marketed as 3x/day (our core “84pins” plan):
- We aim to post at least 84 Pins during each 30-day posting cycle after your account goes live (“Posting Cycle”).
- “Account goes live” means the date we begin regular daily posting following onboarding and setup.
We may occasionally post more than the stated minimum. Some days may have more or fewer posts due to scheduling, holidays, platform issues, or content availability, but we will use reasonable efforts to meet or exceed the total number of posts for each Posting Cycle as described for your plan.
This volume guarantee (where offered) applies only to the specified plan level and only to Posting Cycles where:
- You have completed onboarding and provided sufficient content and approvals; and
- Your account and content comply with Pinterest’s policies and applicable law.
If we materially miss a stated posting minimum in a given Posting Cycle due to our fault, our sole obligation, and your exclusive remedy, will be a credit for a portion of that cycle, as determined in our reasonable discretion. See Section 12 for additional limitations.
5. Payments, Billing & Promotions
5.1 Payments & Auto-Renewal
We use third-party payment processors (such as Stripe) to handle payments. By purchasing a plan, you authorize:
- Our payment processor to charge your chosen payment method (e.g., credit or debit card) for the initial term and automatically for each recurring billing period (e.g., monthly) until you cancel.
Subscription fees are:
- Billed in advance for each billing period, and
- Non-refundable except as required by law or expressly stated in these Terms.
5.2 Promotions, Discounts & Coupon Codes
From time to time, we may offer promotions (for example, percentage discounts on the first month with a coupon code such as “84PINS”). Any such promotions:
- Are subject to the specific terms displayed at the time of offer
- May change or be withdrawn at any time
- Apply only to the qualifying period(s) and plan(s) described in the offer
If there is any conflict between a promotion’s terms and these Terms, the promotion’s specific terms will control for that promotion.
5.3 Taxes
You are responsible for any taxes, duties, or similar charges imposed by governmental authorities in connection with your purchase and use of the Services, excluding taxes on our income.
6. Cancellations & Changes
You may cancel your subscription at any time via the method described in your billing portal or by contacting us at support@84pins.com.
- Cancellations take effect at the end of the current billing period.
- We do not typically provide prorated refunds for partial billing periods unless required by law.
We may, in our sole discretion, allow you to upgrade or downgrade between plans, in which case:
- Changes may take effect in the next billing period or earlier, as indicated at the time of change; and
- Fees may be adjusted accordingly.
We reserve the right to modify or discontinue any plan or feature with reasonable notice. If a change materially affects your current plan, we will make a reasonable effort to notify you in advance and give you the option to cancel before the change takes effect.
7. Your Content & License to Us
You retain all rights to:
- Your website
- Product images
- Logos and trademarks
- Brand guidelines
- Any other content or materials you provide to us or instruct us to use (“Client Content”).
By using the Services, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to:
- Access, use, reproduce, adapt, modify, and display Client Content
- Create derivative works (e.g., Pinterest-specific designs and layouts)
- Publish and distribute Pins and related content on Pinterest and any other platforms you direct us to use
Solely for the purpose of providing the Services and promoting our relationship with you (for example, in case studies or portfolios, subject to any confidentiality restrictions we agree in writing).
You represent and warrant that:
- You own or have all necessary rights, licenses, and permissions to grant the above license, and
- Our use of Client Content in accordance with these Terms will not infringe or violate any third-party rights or applicable laws.
You are solely responsible for the accuracy, quality, and legality of Client Content.
8. Our Content & Intellectual Property
All content, materials, and tools we create or use in providing the Services (excluding Client Content), including but not limited to:
- Pin templates and layouts
- Written copy and frameworks
- Processes, systems, and documentation
- The Site, its text, graphics, design, and underlying code
are owned by or licensed to McFarland Marketing LLC and protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use:
- The Pinterest designs and content we create for your brand
- Solely in connection with your brand’s marketing and internal business purposes
Unless we agree otherwise in writing, you may not:
- Resell our templates or systems as your own service
- Misrepresent our work as created by another provider
- Use our content in a way that violates these Terms or any applicable law
9. Pinterest & Third-Party Platforms
Our Services require the use of third-party platforms (such as Pinterest, Google Drive, Dropbox, Stripe, and others).
You acknowledge and agree that:
- Each platform is governed by its own terms and policies, which you are responsible for reviewing and complying with.
- We do not control these platforms and are not responsible for:
- Their availability, performance, or security
- Changes to their features, algorithms, or policies
- Any suspension, limitation, or termination of your accounts by those platforms
If a third-party platform restricts or suspends your account or content, we are not liable for resulting impacts on the Services.
10. Acceptable Use
You agree not to use the Site or Services to:
- Post or promote content that is illegal, defamatory, fraudulent, obscene, hateful, or otherwise objectionable
- Infringe the intellectual property, privacy, or other rights of any person
- Violate Pinterest’s policies or any applicable law or regulation
- Attempt to gain unauthorized access to our systems or other users’ data
- Interfere with or disrupt the Site or Services
We may, in our sole discretion, suspend or terminate your access to the Services if we believe you have violated these Terms or engaged in behavior that may harm us, other users, or third parties.
11. Termination
We may suspend or terminate your access to the Site or Services, in whole or in part, if:
- You materially breach these Terms and do not cure the breach within a reasonable time after notice (if curable),
- You fail to pay fees when due,
- We are required to do so by law or by a third-party platform’s rules, or
- We decide, in our reasonable discretion, to discontinue the Services.
Upon termination:
- Your right to use the Services will cease,
- Any outstanding payment obligations will remain due, and
- Sections of these Terms that by their nature should survive (including but not limited to payment obligations, IP provisions, limitations of liability, and dispute terms) will continue in effect.
12. Disclaimers
To the maximum extent permitted by law, the Services and the Site are provided “as is” and “as available”, without warranties of any kind, whether express or implied.
We do not guarantee that:
- Any specific level of traffic, clicks, sales, revenue, or other results will be achieved, or
- Pinterest or other platforms will continue to function in any particular way.
You understand and agree that marketing performance depends on many factors outside our control, including your products, pricing, website, customer service, market conditions, and third-party platforms.
We disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the maximum extent permitted by law:
- In no event will 84pins, McFarland Marketing LLC, or our officers, employees, or contractors be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site or Services, even if we have been advised of the possibility of such damages.
- Our total aggregate liability for any and all claims arising out of or relating to the Site, Services, or these Terms will not exceed the amount you paid to us for the Services during the three (3) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the minimum extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless 84pins, McFarland Marketing LLC, and our officers, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Site or Services
- Client Content, including any allegation that it infringes or violates any third-party rights or laws
- Your violation of these Terms or any applicable law or regulation
- Your use of third-party platforms in connection with the Services
15. Governing Law & Dispute Resolution
These Terms will be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms, the Site, or the Services will be resolved in the state or federal courts located in Florida, United States of America, and you consent to the personal jurisdiction of such courts, unless otherwise required by law.
Nothing in this section limits our right to seek injunctive or other equitable relief in any jurisdiction.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. In some cases, we may provide additional notice (such as by email or a notice on the Site).
Your continued use of the Site or Services after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Site and Services.
17. Miscellaneous
- Entire Agreement. These Terms, together with any order form, plan selection, or written agreement referencing them, constitute the entire agreement between you and us regarding the Site and Services.
- Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
- Assignment. You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
